Alec Baldwin is to be charged for involuntary manslaughter over the on-set shooting of Rust cinematographer Halyna Hutchins. The actor who is facing two charges, could spend five years in prison, if convicted of the charge.
New Mexico’s First Judicial District Attorney, Mary Carmack-Altwies, on Thursday announced that Baldwin, the RUST actor and producer, who is 64-years old, will face both charges along with armourer Hannah Gutierrez-Reed, for the October 2021 shooting.
The news release states that under the New Mexico law, the first involuntary manslaughter charge, which is the less serious charge, attracts up to 18 months in jail and a fine of $5,000.
Legal expert and a former Federal prosecutor, Neama Rahmani, predicts that Baldwin would spend at least a year in jail if found guilty on this charge.
In the second and more serious charge of involuntary manslaughter in the commission of a lawful act, which includes a firearm enhancement, Baldwin faces a mandatory five year sentence upon conviction in a state prison, according to the DA’s news release.
The DA’s news release states that it is not a case of whether or not they were guilty, but under which law they were guilty, which would be decided by a jury.
Rahmani shares the opinion that Baldwin would be treated as a celebrity by being isolated from the general prison population.
Meanwhile in a statement, Baldwin’s attorney Luke Nikas of Quinn Emanuel has said the decision to charge Baldwin distorts Halyna Hutchins’ tragic death and described it as a terrible miscarriage of justice.
He said there was no way Mr. Baldwin could have known that there was a live bullet in the gun or anywhere on the movie set. According to him, Baldwin relied on the professionals with him on stage, who had given him assurance that the gun did not have live rounds.
He boasted of their willingness to fight until the case is won.
Family of Hayla Hutchins, the cinematographer who got killed on the set of Rust, have backed the decision of the prosecutor to file criminal charges against Alec Baldwin and Hannah Gutierrez-Reed.
In a statement made available to newsmen, attorney for the Hutchins family, Brian J. Panish on behalf of the family, thanked the Santa Fe Sheriff and the District Attorney for their thorough investigation and their decision to slam charges for involuntary manslaughter for killing Hutchins with conscious disregard for human life.
The charges are expected to be concluded at the end of this month.
