Cares Act EARLY Release
Pursuant to a US DOJ released memorandum directing bureau officials to “immediately maximize appropriate transfers to home confinement” and consider “all at-risk inmates — not only those who were previously eligible for transfer, we will draw up a petition asking that you be sent home early based on the Cares Act, as well as other applicable release programs.
Cares Act, section 12003(b)(2) authorizes the Director of the Bureau of Prisons to “lengthen the maximum amount of time for which the Director is authorized to place a prisoner in home confinement under the first sentence of section 3624(c)(2) of title 18, United States Code, as the Director determines appropriate.
First Step Act Early Release
We will be generating documentation for the inmate to submit to the BOP and coaching the inmate to ensure that they meet the criteria to take advantage of the programs offered by the First Step Act to obtain 10 to 15 days of custody credit for release from the BOP pursuant to the policies of the FSA.
RDAP Early Release
RDAP authorizes the Bureau of Prisons to place inmates with substance abuse issues like excessive drinking, and abuse of legally prescribed medication as well as illicit drugs such as marijuana or cocaine, into a 500 hour treatment program that allows inmates up to a 1 year sentence reduction along with 6 months in a halfway house / home confinement setting at the end of their sentence.
